Terms and Conditions

TJ Mattresses and More Ltd

These Terms and Conditions (“Terms”) govern all sales and services provided by TJ Mattresses and More Ltd (“we,” “our,” or “us”) to clients, including but not limited to HMOs, serviced accommodation providers, managed properties, property stagers, and care homes (“you,” “your,” or “the client”). By placing an order, you agree to be bound by these Terms.

1. Orders and Acceptance

1.1 Orders must be placed in writing (email, WhatsApp, purchase order, or invoice confirmation).
1.2 No order is binding until confirmed by us in writing.
1.3 We reserve the right to refuse or cancel orders at our discretion.

2. Products and Specifications

2.1 While we take care to ensure product descriptions, specifications, and images are accurate, variations may occur.
2.2 We reserve the right to make reasonable product substitutions or improvements without prior notice.
2.3 Mattress comfort, firmness, or subjective performance is not a valid reason for return unless the product is demonstrably faulty.

3. Pricing and Payment

3.1 All prices are quoted exclusive of VAT unless otherwise stated.
3.2 Payment terms will be agreed upon at the point of order. Unless otherwise stated, payment is due prior to delivery.
3.3 Late payments may incur interest at 8% above the Bank of England base rate per annum, plus reasonable debt recovery costs.

4. Delivery and Installation

4.1 Delivery dates are estimates only. We are not liable for delays outside of our control (including supply chain issues, transport delays, or access problems at the property).
4.2 The client is responsible for ensuring safe and adequate access for delivery and installation.
4.3 Failed delivery attempts caused by insufficient access or client absence may result in additional charges.

5. Risk and Title

5.1 Risk in goods passes to you upon delivery.
5.2 Title to goods remains with us until full payment has been received.

6. Returns, Cancellations, and Refunds

6.1 Cancellations must be made in writing prior to dispatch; otherwise, full payment is required.
6.2 Bespoke or special-order items are non-cancellable and non-refundable.
6.3 Returns are only accepted where goods are demonstrably faulty or damaged on delivery. Claims must be made within 48 hours of receipt with photographic evidence.
6.4 We do not accept returns for reasons of change of mind, tenant preference, or general wear and tear.

7. Warranties

7.1 Goods are covered by the manufacturer’s warranty (where applicable).
7.2 Warranty claims require proof of purchase and compliance with care instructions.
7.3 Damage due to misuse, negligence, or improper handling is not covered.

8. Liability B

8.1 Our liability is strictly limited to the replacement, repair, or refund of the goods supplied.
8.2 We are not liable for indirect, consequential, or financial losses (e.g., tenant complaints, void periods, loss of rent, or staging impact).
8.3 Nothing in these Terms excludes liability for death or personal injury caused by negligence.

9. Client Responsibilities

9.1 You are responsible for ensuring goods are suitable for your intended purpose.
9.2 You must comply with all health and safety requirements relating to furniture use in your properties (including fire regulations and HMO compliance).
9.3 We do not accept liability where goods are used outside of their intended commercial or residential purpose.

10. Force Majeure

We shall not be held liable for delays or failures caused by events beyond our reasonable control, including but not limited to strikes, natural disasters, transport issues, or supply chain disruption.

11. Data Protection

We will only use your personal and business data for legitimate purposes in line with GDPR and will not share data with third parties without consent, except where required to fulfill orders or by law.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
